Terms and Conditions of Use

Chapter 1 General Provisions

Article 1 (Purpose)

The purpose of these Terms and Conditions of Use is to set forth the rights, obligations, and responsibilities of the website (hereinafter referred to as the “Site”) and the users in relation to the use of the online services (hereinafter referred to as “Services”) on the Site operated by the Korea Medical Foundation (hereinafter referred to as “KOMEF”) and its Users.

Article 2 Effectiveness and Change of Terms and Conditions
  1. (1) These Terms and Conditions shall be effective upon notice to the User through the Site.
  2. (2) KOMEF may revise the Terms and Conditions in the event of changes in circumstances or when it is necessary for business operations, and the revised Terms and Conditions shall take effect in the same manner as the preceding paragraph.
Article 3 Other Rules

If any matters not specified in these Terms and Conditions are stipulated in the relevant laws and regulations, the relevant provisions shall be observed.

Chapter 2 Membership Registration and Use of Services

Article 4 Definition of Member

A “member” is a regular individual recognized by KOMEF as being suitable for membership, who agrees to these Terms and Conditions, fills out the sign-up form for the Services, and is issued an ID and password.

Article 5 Registration for the services

(1) The User shall apply for membership by filling out the membership information according to the form prescribed by KOMEF and expressing his/her agreement to these Terms and Conditions.

(2) KOMEF shall register users who apply for membership as described in the preceding paragraph as members unless they fall under any of the following conditions

  1. A. The application is filed using the name of another person
  2. B. The person did not sign up under his/her real name
  3. C. There is any falsified information, omissions, or errors in the membership application form
  4. D. The application is filed for the purpose of disrupting order in society or undermining morals and customs

(3) If it is necessary to use the User’s personal information during the provision of the Services, KOMEF may collect personal information by obtaining consent without membership registration.

Article 6 Service Use and Restrictions

(1) The Services shall be available 24 hours a day, every day throughout the year, unless there are special business or technical difficulties for KOMEF.

(2) The hours of use of the Services described in the preceding paragraph may be restricted after prior notice to the members if it is deemed necessary by KOMEF, such as for regular system maintenance.

(3) Online consultation may not be available 24 hours a day depending on the personal circumstances of the doctor responsible for responding to inquiries.

Chapter 3 Withdrawal, Re-Registration and Restricted Use of the Services

Article 7 Withdrawal from the Services

Members may request to withdraw their membership at any time by modifying their membership information, and KOMEF will immediately process the withdrawal request.

Article 8 Re-Registration for the Services

If a former member who has withdrawn his/her membership in accordance with the provisions of Article 7 of these Terms and Conditions wishes to re-register, he/she may do so in accordance with Article 5 of these Terms and Conditions.

Article 9 Restricted Use of the Services

KOMEF may terminate the contract for the use of the Services without prior notice or suspend the use of the Services for a specified period of time if the member commits any of the following acts.

  1. A. Undermined public order, morals, or customs
  2. B. Involved in a crime
  3. C. Planned to use the Services for the purpose of undermining national interest or social public interest or executed the plan
  4. D. Used another individual’s ID and password without authorization
  5. E. Defamed others or causing disadvantages to others
  6. F. Registered with a different ID (dual registration)
  7. G. Caused harm to the service or otherwise interfered with the sound use of the Services
  8. H. Violated relevant laws and regulations or the terms of use set forth on the Site

Chapter 4 Limitation of Liability for the Services

Article 1 Online Consultation

1) KOMEF strives to maintain security so that the details of the consultation service provided to members or users of the Service are not leaked to third parties other than the consulting doctor and the Service administrator. However, KOMEF is not responsible for the disclosure or loss of consultation details in the following cases

  1. A. The user’s password is leaked due to user negligence and the details of the consultation are leaked as a result
  2. B. The user deleted the consultation details using the “Delete” function
  3. C. The consultation details are disclosed or lost due to a natural disaster or circumstances beyond the control of KOMEF

(2) In order to provide a comprehensive and appropriate response to the consultation requested by the member, the attending doctor and specialists from various departments may refer to the consultation details and responses.

(3) The details of the consultation provided via the Services on the Site may be used for the following purposes after deleting the User’s personal identification information

  1. A. Academic activities
  2. B. Authoring activities for printed materials, CD-ROMs, etc.
  3. C. Part of the Service details such as FAQs and recommended consultations

(4) The answers to inquiries are subjective answers based on the medical knowledge of the medical specialist providing them and do not represent the opinions of the corporate program.

(5) Online consultation may not be provided, in whole or in part, in the following cases

  1. A. The User repeatedly requests a consultation on the same matter
  2. B. The User requests a consultation using vulgar expressions
  3. C. The User requests a consultation to demand a diagnosis
  4. D. The User requests a consultation regarding treatment fees, test fees, drug prices, etc.
Article 11 Information Service

(1) The content provided via the Service is rough and general in nature. The information provided and consultation cannot substitute a medical diagnosis and are provided simply to deliver information. If you have any questions or concerns about your health, you should seek the advice of an actual medical professional. Under no circumstances should you disregard a doctor’s diagnosis or delay seeking diagnosis, care, or treatment because of the information provided via the Services.

(2) KOMEF does not recommend any specific tests/exams, products, or treatments mentioned in the Services. Any opinions expressed in the Services are those of the consulting doctor. KOMEF is not responsible for the contents of any documents or consultations provided via the Services.

(3) Your acceptance of any information provided via the Services, the opinions of any practitioner participating in the Services, or any other member or visitor using the Services is solely at your own discretion. Accordingly, KOMEF cannot be held liable for any damages, injury, or other adverse consequences arising from the utilization of any product, information, ideas, or instructions provided as such.

Chapter 5 Obligations

Article 12 Obligations of KOMEF

(1) KOMEF is obligated to provide continuous and reliable services as stipulated in these Terms and Conditions and the Agreement, unless there are special circumstances such as system inspection, service development, communication failure, or other force majeure accidents.

(2) KOMEF will do its best to ensure the security of the personal information of Users, including credit information, by taking technical safety measures and managing the information with utmost care.

(3) You may view your personal information at any time and request KOMEF or the information management officer to correct any incorrect information.

(4) In principle, KOMEF will not disclose or distribute personal information of users to third parties without User consent, except in the following cases

  1. A. It is requested by a national institution in accordance with the provisions of laws such as the Framework Act on Telecommunications
  2. B. It is for the purpose of criminal investigation or requested by the Information and Communication Ethics Committee
  3. C. If it is necessary for statistical data compilation, academic research, or market research and is provided in a form that cannot identify specific individuals
  4. D. It is to provide developers with the information necessary to develop new features, information, and services useful to members
  5. E. It is used by KOMEF to provide advertisements or Services according to the preferences of members and Users
Article 13 Users’ Obligations Related to Their IDs and Passwords

(1) The User must use an ID and password for some functions when using the Services

(2) Users are responsible for the management of their IDs and passwords

(3) Users must not allow any third party to use your ID and password

(4) In case his/her ID is used fraudulently, the User must notify KOMEF

Article 14 Obligations of Users

(1) The User shall not engage in any of the following acts when using the Services

  1. A. Reproduce or utilize information obtained via the Services for purposes other than his/her own use without the prior consent of KOMEF
  2. B. Infringe on KOEF’s copyright or other rights of others, including copyrights
  3. C. Disseminate information, sentences, figures, etc. that under public order, morals, and customs
  4. D. Engage in acts objectively judged to be connected to a crime
  5. E. Engage in acts that are violation of laws and regulations

(2) Users shall comply with the relevant laws and regulations, the matters stipulated in these Terms and Conditions, and the Service use guidelines and instructions.

(3) Users shall comply with the restrictions on use posted by KOMEF in the Service announcement or separately announced by KOMEF.

(4) Users shall not engage in any profiteering activities using the Services without the prior consent of KOMEF.

Chapter 6 Miscellaneous

Article 15 Dispute Mediation

(1) Disputes concerning any matters related to the use of the Services that arise, except as stipulated in these Terms and Conditions, shall be resolved by mutual agreement as much as possible.

(2) If a lawsuit is filed for a dispute arising from the use of the Services, the court having jurisdiction over the location of the Foundation shall be the competent court.

Addendum

These Terms and Conditions shall come into effect on August 1, 2023.
